Human Resources Management in Azerbaijan: Employment Contracts, HR Administration and Compliance

Effective human resources management is not limited to managing employees. It also includes employment contracts, personnel administration, HR documentation, leave management, payroll-related processes and compliance with labour legislation.

For companies operating in Azerbaijan, properly formalizing employment relationships is particularly important. An employment contract establishes the legal basis of the relationship between an employee and an employer.

Therefore, an effective HR system should cover the entire employment cycle — from recruitment and employment contract formalization to changes in employment conditions and termination.

Why Is an Employment Contract Important?

An employment contract is the main legal document establishing the employment relationship between an employee and an employer. Under Azerbaijan's Labour Code, the contract must include the required terms and information and reflect the agreement of the parties.

Among other matters, the contract should properly define the employee's duties, workplace, working conditions, salary and other essential employment terms.

Properly formalizing an employment contract helps reduce legal risks for employers and protects employees' labour and social rights.

What Is Personnel Administration?

Personnel administration means the systematic management of employee-related information, documents and employment relationships within a company.

It may include:

  • maintaining employee records;
  • preparing and formalizing employment contracts;
  • recruitment and termination procedures;
  • changes to employment contracts;
  • formalizing positions and job responsibilities;
  • managing salary-related information;
  • leave administration;
  • working-time and attendance records;
  • preparing HR orders and other personnel documents;
  • ensuring compliance with labour legislation.

Systematic personnel administration helps companies manage their HR operations more efficiently and maintain proper employment documentation.

ƏMAS and Electronic Employment Contracts

The Employment and Occupation Subsystem (ƏMAS) has become an important part of HR processes in Azerbaijan as employment relations become increasingly digitalized.

According to official information, 97% of active employment contracts had been concluded electronically as of April 2026. ƏMAS enables employers and employees to manage electronic employment contracts and supports digital personnel administration.

Since July 2026, a new mechanism has also been introduced for electronically confirming amendments to employment contracts through ƏMAS. According to the new procedure, amendments made by the employer must be electronically confirmed by both the employer and employee within 48 hours.

This makes timely monitoring and proper management of electronic HR documents increasingly important for companies.

Key Areas Requiring Attention in HR Processes

1. Recruitment and Employment Contracts

Before hiring an employee, the position, duties, workplace, salary and other employment conditions should be clearly defined.

2. Amendments to Employment Contracts

Changes to salary, position, job responsibilities or other employment conditions should be properly documented and reflected in the relevant electronic records.

3. Leave Administration

Proper management of employees' leave rights is an important part of HR administration. Leave planning and documentation should be handled systematically.

4. Working Time and Attendance

Working hours, work schedules, rest days and overtime-related processes should be properly documented and managed.

5. Termination of Employment

When employment is terminated, the legal basis, relevant documentation and accurate recording of information in the electronic system should be taken into account.

6. HR Documentation

Employment contracts, HR orders, leave documents, employee information and other personnel records should be maintained systematically.

2026 Changes in Labour Legislation

Significant changes to employment legislation entered into force in Azerbaijan in 2026. According to the Ministry of Labour and Social Protection of Population, more than 400 amendments were made to the Labour Code and other legislation.

Among the changes, the concept of an “employee with family responsibilities” was introduced into the Labour Code.

Changes were also adopted regarding the review of the minimum wage amount at least once a year.

Such developments make it important for companies to regularly review their HR policies, employment contracts, personnel documents and internal employment processes.

Why Is HR Compliance Important?

Labour-law compliance is not limited to preparing documents formally. It is also important that actual working conditions correspond to the information documented by the company.

The State Labour Inspection Service exercises state control over compliance with labour legislation, including employment contracts, wages, leave, working hours and occupational safety.

For companies, HR compliance, proper personnel documentation and legally compliant employment processes are therefore important for reducing potential legal and administrative risks.

A Systematic Approach to Human Resources Management

As a company grows, increasing numbers of employees require HR processes to be managed in a more structured way.

An effective HR system helps with:

  • proper formalization of employment relationships;
  • systematic personnel administration;
  • accurate HR documentation;
  • labour-law compliance;
  • structured recruitment and termination procedures;
  • effective leave and working-time management;
  • standardization of internal HR processes.

ABSP provides companies with support in human resources and migration, including employment contract preparation, personnel documentation, labour-law compliance assessment, HR policies and procedures, work permits and temporary residence permits.

A properly structured HR system supports not only documentation but also the company's overall management structure.
